Woman sues radiologist, Greenbrier Clinic for terminal cancer misdiagnosis

BECKLEY — A woman whose terminal cancer went undiagnosed is suing a radiologist and clinic for their alleged failure to assess, diagnose and treat her.

Martha McKee filed the lawsuit against the Greenbrier Clinic and Dr. Brandon Chan in U.S. District Court for the Southern District of West Virginia.

McKee claims she went for her annual exam in May 2017 and Chan failed to properly assess, diagnose and treat a highly suspicious mass that was found in McKee's breast and she was told that she was fine.

However, McKee's mass was not fine and it later metastasized and spread to her internal organs and when she was diagnosed more than one year later, her cancer was deemed terminal, according to the suit.

McKee claims if her cancer had been diagnosed in May 2017, she would have had an 85 to 97% chance of five-year cancer-free survival, but when she was finally diagnosed she was Stage 4 and her five-year cancer-free survival rate was close to zero.

Chan and the clinic were medically negligent, according to the suit.

McKee is seeking compensatory and punitive damages. She is represented by R. Booth Goodwin II, Benjamin B. Ware and Shanna L. Brown of Goodwin & Goodwin.
