Woman says surgeon left tubing inside of her during surgery

CHARLESTON — A Mingo County woman is suing Dr. Robert Shin after a CT scan found a foreign body inside her pelvis that was left during surgery.

Heather Thompson went to Shin for weight loss surgery and after the procedure, she continued to experience flank pain, according to a complaint filed in Kanawha Circuit Court.

Thompson went to Dr. Jose Auditor for a CT scan and a catheter fragment was found in her left hemipelvis and she underwent surgery to remove the fragment by Dr. David Denning on March 5, 2020.

"Dr. Shin failed to visualize and remove the segment of clear synthetic tubing from the Plaintiff's abdomen following her weight loss surgery," the complaint states.

Thompson claims Shin's actions clearly fell below the standard of care.

Thompson is seeking compensatory damages with pre- and post-judgment interest. She is represented by Robert B. Kuenzel of Kuenzel Law.
