Couple sues OneMain Financial for failing to honor policy

CHARLESTON — A couple is suing OneMain Financial and Triton Insurance Company for failing to honor an involuntary unemployment insurance policy.

Clarence Tuell and Jeanie Tuell were solicited by the defendants in 2020 to refinance their existing loan and take cash out, according to a complaint filed in Kanawha Circuit Court.

The Tuells claim they began to make payments, which included payments for an insurance policy underwritten by Triton and in August, Jeanie Tuwell's workplace closed due to the COVID-19 pandemic and Tuell was unemployed.

The plaintiffs claim the defendant failed to honor the insurance contract and the Tuells do not have the income to make payments on the loan.

The Tuells claim the defendants represented that an involuntary unemployment insurance policy would cover payments on the loan, but failed to honor that when the time came.

The Tuells are seeing compensatory and punitive damages. They are represented by Clint Carte and Daniel F. Hedges of Mountain State Justice in Charleston.
