Couple sues State Farm for unknown removal of coverage

WEST UNION — A Salem couple is suing State Farm Mututal Automobile Insurance Company alleging collision coverage was removed from their insurance policy without their consent.

Rob Johnson, an agent for Rob Johnson Insurance Agency was also named as a defendant in the suit.

Lewis Swann and Helen Swann had a policy through State Farm and purchased that policy through Johnson, according to a complaint filed in Doddridge Circuit Court.

The Swanns claim Amanda Adkins, their son's girlfriend, was using their vehicle and was involved in an accident on Aug. 8, and while the policy was in full effect, the collision coverage had been removed from the policy unbeknowst to the plaintiffs.

The plaintiffs did not discover the coverage had been removed until State Farm denied their claim for collision coverage. They claim in removing the coverage, State Farm caused them to suffer an uninsured loss with respect to their vehicle.

The Swanns are seeking compensatory damages not to exceed $75,000. The Swanns are represented by Todd Wiseman of Wiseman Law Firm.
