Mother sues Cabell board of education for son's injuries from aide

HUNTINGTON —An unnamed woman is suing the Cabell County Board of Education for injuries sustained by her minor child by a special needs aide.

Jane Doe claims Jason Curry, an aide to the victim, inappropriately touched her child, the victim, on Oct. 15, 2019, and again on Nov. 22, 2019, according to a complaint filed in U.S. District Court for the Southern District of West Virginia.

The 12-year-old victim was unable to tell his parents what occurred because of his severe disability and neither of the victim's parents were told or otherwise advised by the school regarding the incident.

On Nov. 22, 2019, another incident occurred involving Curry and the victim in which Curry was alleged to be engaging in "forcible fondling" of the victim and the sheriff's department was notified. Curry was later charged with sexual abuse in the second degree.

Doe is seeking compensatory and punitive damages. She is represented by Robert M. Bastress III of DiPiero Simmons McGinley and Bastress in Charleston.
