CHARLESTON — An insurance company is suing ZMM Architects & Engineers for damages sustained by a church it insured.
Christ Church United Methodist was insured by Brotherhood Mutual Insurance Company for its property and ZMM Architects & Engineers designed a renovation for the church's education wing, according to a complaint filed in Kanawha Circuit Court. Progressive Electric Inc. was contracted to install supports for multiple raceways to support equipment and components.
The system failed on July 29, 2019, through no fault of the church and the church sustained serious structural damages and made an insurance claim through Brotherhood in the amount of $69,710.71.
The defendants' negligence in its design and installation caused the church to sustain damages. The defendants breached their warranties.
Brotherhood is seeking judgment for the amount it paid out to the church. It is represented by Debra Varner, Jeffrey D. Volkenburg and James A. Varner Sr. of Varner & Van Volkenburg in Clarksburg.
