Woman sues Bob Evans for gender bias, alleges pay discrepancies

CHARLESTON — A woman is suing Bob Evans after she claims she was subjected to a hostile work environment and gender bias.

Holly Barta filed the lawsuit against Bob Evans Restaurants and Thomas D. Staker claiming that during her employment, she experienced gender bias at the hands of Staker, according to a complaint filed in Kanawha Circuit Court.

Barta claims she was employed by the defendants for four years and was informed in May or June 2019 that she and other female managers would only be receiving a 2% raise while male managers would be receiving a 3% raise. 

Staker told Barta this was becayse he could not have men working for less per year because they had families to raise, even though both Barta and the other female managers also had families to raise.

Barta claims she was subjected to a hostile work environment until she was discharged from her employment on Feb. 21, 2020.

Barta is seeking compensatory and punitive damages. She is represented by Tammy Bowles Raines of Tammy Bowles Raines Law Office.

The case is assigned to Circuit Judge Carrie Webster.
