Man sues Adell Polymers for wrongful termination

PETERSBURG — A Hardy County man says Adell Polymers and its plant manager wrongfully terminated his employment.

Jason Arnold was employed by Adell and Chuck Kesner was his supervisor and he suffered a workplace injury on Nov. 2 when he bent down to move a hose and felt a sharp pain in his lower back, according to a complaint filed in Grant Circuit Court

Arnold claims he reported the workplace injury and filled out the proper paperwork and was evaluated. He was told to avoid bending over, twisting, jumping, climbing and prolonged sitting or standing for a period of time, but when he presented the work restriction to Kesner, he was sent home and told Adell didn't "do restrictions."

When Arnold returned to work several weeks later, he was ordered to perform a task that was still strictly prohibited by his work restrictions and when he informed Kesner of this, his employment was terminated, according to the suit.

Arnold is seeking compensatory and punitive damages. He is represented by Jerry D. Moore and Jared T. Moore of the Moore Law Firm and Nathan H. Walters of Walters and Heishman.
