CHARLESTON — A Huntington man is suing Top Notch Tree Service after he was struck by a falling tree limb.
Shane Meade filed the lawsuit against Timothy L. Trimble, who is doing business as Top Notch Tree Service or Top Notch Tree Care alleging that while he was working as a temporary or volunteer employee as a laborer, he was struck by a falling tree limb and injured, according to a complaint filed in Kanawha Circuit Court.
Meade claims the defendants were cutting tree limbs on July 12, 2019, when they failed to sure that bystanders and workers were out of the way and dropped tree limbs onto the ground, one of which struck him and caused him compound fractures to his left femur, tibia and fibula.
Meade claims the defendants were negligent and violated state statutes. He claims the dangerous work environment was also a violation of West Virginia code.
Meade is seeking compensatory and punitive damages. He is represented by J. Kristofer Cormany of Cormany Law in Charleston.
The case is assigned to Circuit Judge Joanna Tabit.
