Man sues Aetna for benefits denial

CLARKSBURG — A man is suing Aetna Life Insurance Company for denying his long-term disability benefits.

Douglas Eaton became eligible for long-term disability insurance worth $4,760.12 per month and Aetna was responsible for paying the benefits, but it denied his benefits, according to a complaint filed in U.S. District Court for the Northern District of West Virginia.

Eaton claims he appealed the denial of the claim and the defendant failed to consider his appeal. He claims it also failed to adequately explain why it rejected the evidence in his file and why it denied his benefits.

The plaintiff believes the defendant's actions were a violation of the Employee Retirement Income Security Act and caused him damages, according to the suit.

Eaton is seeking payment of his benefits owed to him with pre-judgment interest. He is represented by Walt Auvil of The Employment Law Center.

The case is assigned to District Judge Irene Keeley.
