Woman sues Montana Sky LLC for injuries from fall

NEW CUMBERLAND — A woman says Montana Sky LLC and unknown and unnamed employees of the company for injuries she sustained when she fell on their property.

Barbara Spinella was on a sidewalk in Weirton on March 8, 2019, when she fell and was injured, according to a complaint filed in Hancock Circuit Court.

Spinella claims the defendants allowed the sidewalk to be in a hazardous condition and omitted or neglected to maintain the area in a reasonably safe condition.

The defendant also failed to warn individuals of the condition and she suffered severe and permanent injuries due to the fall, according to the suit.

The defendant was negligent and careless in failing to fix the sidewalk that had fallen into disrepair and caused Spinella's injuries, according to the suit.

Spinella is seeking compensatory damages with pre- and post-judgment interest. She is represented by Dean G. Makricostas of Dittmar, Taylor & Makricostas PLLC in Weirton.
