Man sues Lo Down Energy for work-related injuries

PINEVILLE — A Princeton man is suing his former employer and several other entities after he was injured on the job.

Lo Down Energy, JSW Steel, Planck Holdings and Caretta Minerals were all named as defendants in the suit.

Seth White was employed by Lo Down as a laborer at Mine No. 32 in McDowell County on Nov. 15, 2019, when he was instructed to operate a scoop on his shift that did not have a canopy and while doing so, an unsupported rib that was 40 inches in length, 34 inches in height and 24 inches in thickness broke free and fell, crushing White against the deck of the scoop, according to a complaint filed in Wyoming Circuit Court.

White claims state and federal mine authorities investigated the incident and determined that prior to the incident, adequate examinations of the section were not being made, according to the suit.

White is seeking compensatory and punitive damages with pre- and post-judgment interest. He is represented by D. Blake Carter Jr. of Bailey Javins & Carter in Charleston.

The case is assigned to Circuit Judge Warren McGraw.
