Allstate sues Genova for defective product that caused water damage

KEYSER — Allstate Insurance Company is suing Genova Products alleging that personal property was damaged as a result of Genova's negligence.

Allstate alleges that the home of Donald Trail, who had an Allstate policy, sustained water damage on Feb. 13, 2019, when a threaded CPVC adapter manufactured by Genova failed and caused Trail's home to sustain serious damage due to a water leak, according to a complaint filed in Mineral Circuit Court.

The damage sustained to Trail's home was a total of $18,937.59. Allstate made payments on Trail's behalf to fix the damages, according to the suit.

Allstate claims Genova was negligent and breached its warranty. It also claims Genova is liable for the damages sustained.

Allstate is seeking judgment against Genova along with pre- and post-judgment interest. It is represented by James C. Stebbins and Andrew W. Holbrook in Charleston.

The case is assigned to Circuit Judge Lynn Nelson.
