CHARLESTON — A woman is suing Bentz Property & Contracting alleging that it started a remodel on her home, but failed to complete the work.
Roger Pence was also named as a defendant in the suit.
Rachel Newborn contacted the defendants in 2016 regarding remodeling and contracting work because she intended to remodel and renovate her home in Charleston, according to a complaint filed in Kanawha Circuit Court.
Newborn claims the defendants agreed to remodel her home by adding floor to the bedrooms and bathrooms, a complete renovation to the kitchen, new stucco and vinyl finishings for the exterior of the home and foundation work and work done to the bathrooms.
The plaintiff was never provided a written contract and after receiving her downpayment, the defendants began requesting more money but eventually stopped working on the remodel and did not finish it. Newborn claims her home was left in an inhabitable condition.
Newborn is seeking compensatory and punitive damages. She is represented by Bradley D. Dunkle, L. Dante diTrapano and D. Christopher Hedges of Calwell Luce diTrapano in Charleston.
The case is assigned to Circuit Judge Joanna Tabit.
