CHARLESTON — A man is suing Riverside Health and Rehabilitation Center for his sister's death from COVID-19.
St. Albans Operating Company is doing business as Riverside Health and Rehabilitation Center.
SavaSeniorCare Administrative Services and SavaSeniorCare Consulting Inc. were also named as defendants in the suit.
Mary M. Bateman was a nursing home resident at the defendants' center beginning Feb. 15, 2019, according to a complaint filed in Kanawha Circuit Court.
Thomas Collier claims during Bateman's residency, the defendants failed to provide adequate supervision and failed to implement and follow appropriate and effective infection control measures.
Bateman contracted COVID-19 and died. Collier claims the defendants are responsible for his sister's wrongful death.
Collier is seeking compensatory and punitive damages. He is represented by Jeff D. Stewart, Andrew L. Paternostro and S. Andrew Stonestreet of Stewart Bell PLLC in Charleston.
The case is assigned to the late Circuit Judge Charles King's court. Maryclaire Akers recently was appointed to fill King's seat.
