Woman says she was injured falling on city sidewalk

CHARLESTON — A woman who was injured while jogging on a city sidewalk is suing the city of Charleston for her injuries.

Mary Maddox was jogging on a city sidewalk in Charleston on April 16, 2019, when she tripped and fell on a portion of the sidewalk that had fallen into disrepair, according to a complaint filed in Kanawha Circuit Court.

Maddox claims she was injured when she fell and the city knew or should have known that the sidewalk was defective and hazardous and was not being maintained.

"As a direct and proximate result of the negligence and carelessness of the Defendant, the Plaintiff was injured and has undergone medical treatment; has incurred medical expenses and will continue to incur medical expenses in the future; has endured pain and suffering, both in the past and in the future; and the Plaintiff has in the past suffered annoyance, aggravation, and mental anguish and will continue to do so in the future," the complaint states.

Maddox is seeking compensatory and special damages. She is being represented by Kevin P. Davis and Mark Plants in South Charleston.
