CHARLESTON — A Kanawha County woman is suing Joe Holland Chevrolet alleging she was wrongfully terminated from her employment because she is a woman.

Nancy Beth Kogoy was employed by Joe Holland Chevrolet for approximately 32 years until she was fired on April 22, 2020, according to a complaint filed in Kanawha Circuit Court. She says she was fired after she testified in a deposition regarding a gender and age discrimination case against the plaintiff.

Kogoy claims her job duties were then taken over by a male employee. She claims she was discharged based on her sex, which violates the West Virginia Human Rights Act.

"Defendant's actions were willful, wanton and/or undertaken with reckless disregard and/or reckless indifference to the rights of the plaintiff entitling the plaintiff to punitive damages in an amount to be determined by the jury," the complaint states.

Kogoy claims she suffered embarrassment, humiliation, emotional distress with physical manifestations and indignity due to the defendant's actions.

Kogoy is seeking compensatory and punitive damages with pre-judgment interest. She is represented by Mark A. Atkinson of Atkinson & Polak in Charleston.

The case is assigned to Circuit Judge Tera Salango.
