Woman sues business for sidewalk in disrepair

NEW CUMBERLAND — A woman is suing 3101 Main Street LLC after she was injured on a sidewalk in front of its place of business.

Barbara Spinella was on the sidewalk on March 8, 2019, when she tripped and fell on a hazardous condition that existed on the sidewalk in front of 3101 Main Street LLC, according to a complaint filed in Hancock Circuit Court. The business formerly was Rumorz BYOB Showbar.

Spinella claims the defendants carelessly and negligently failed, omitted and neglected to maintain the sidewalk that was used by the general public in a reasonably safe condition. 

The defendant allowed and permitted the sidewalk to fall into disrepair when it knew or should have known that the disrepair could cause injuries, according to the suit.

Spinella is seeking compensatory damages. She is represented by Dean G. Makricostas of Dittmar Taylor & Makricostas in Weirton.

The case is assigned to Circuit Judge Ronald Wilson.
