Woman sues physician for daughter's death

FAYETTEVILLE — A woman is suing Dr. Howard Newmark for her daughter's death.

Oak Hill Hospital Corporation, which is doing business as Plateau Medical Center, was also named as a defendant in the suit.

Abagail Vest presented to the emergency room at Plateau on My 15, 2019, with pain in her left wrist and shoulder, right foot pain, fever, dark and pungent urine and dry mouth and was seen by Newmark, who diagnosed her with a urinary tract infection and pain in her left wrist, left shoulder and right foot, according to a complaint filed in Fayette Circuit Court.

Pamela Vest claims Abagail Vest went back to the emergency department on May 21, 2019, and was diagnosed with septic pulmonary embolism and a peritoneal abscess and was then transferred to Charleston Area Medical Center, but she died the next day due to sepsis.

The defendants ignored the signs of worsening infection despite evidence showing Abagail Vest's condition, according to the suit.

 Pamela Vest is seeking compensatory and punitive damages. She is represented by Bradley D. Dunkle and L. Dante diTrapano of Calwell Luce diTrapano in Charleston.

The case is assigned to Circuit Judge Paul Blake.
