Individuals sue Triad Hunter, SWN Production Company over gas, mineral rights

WHEELING — Three individuals are suing Triad Hunter and SWN Production Company regarding gas and mineral rights.

Jan Meredith, Luanne Beard and Cathy Meredith filed the lawsuit over oil and gas minerals in Tyler County that previously belonged to William H. Meredith and James R. Meredith who died and left their leases to their family, according to a complaint filed in U.S. District Court for the Northern District of West Virginia.

The plaintiffs claim Triad and SWN have deducted post-production costs from the plaintiffs' royalties for services other than gathering, transportation, compression and line loss and the deductions exceeded 2.25%.

The plaintiffs have attempted to communicate with the defendants, but the defendants failed to cure the breaches of the leases and have not responded to the correspondence.

The plaintiffs are seeking compensatory and punitive damages with pre- and post-judgment interest. They are represented by Christian E. Turak of Gold Khourey & Turak and Daniel J. Guida of Guida Law Offices.

The case is assigned to Circuit Judge John Preston Bailey.
