Woman sues Moses Chevrolet after falling on walkway

CHARLESTON — A woman is suing Moses Chevrolet alleging injuries when she fell on the defendant's walkway.

Mary Christy was at Moses Chevrolet on March 7, 2019, getting her car serviced when an employee of the defendant backed her vehicle out of the garage for her to retrieve, according to a complaint filed in Kanawha Circuit Court.

Christy claims the employee left the driver-side door open, blocking her view of the walkway and she fell because she was not aware of defects in the walkway.

"The Defendant owed a duty to care to the people that walk on its premises to keep it in a manner that does not allow hazardous conditions to develop," the complaint states. "The Defendant is responsible through the actions and non-actions of its employees...and had a duty to make sure the premises was safe for the public."

Christy claims she suffered severe injuries to her right foot when she fell.

Christy is seeking compensatory damages with pre- and post-judgment interest. She is represented by Kevin P. Davis and Mark Plants.

The case is assigned to Circuit Judge Joanna Tabit.
