WEST UNION — Eight individuals are suing Antero Resources alleging that it failed to pay royalties.
Seneca-Upshur Petroleum was also named as a defendant in the suit.
Sam Horton, Frank Butler, Ken Horton, John Horton, Eric Horton, Lisa Dawn Mullooly, Edward Mullooly II and Lisa Joette Chambers allege that in 1984, J & J Enterprises entered into an agreement with Edward Mullooly wherein he would be an independent contractor to obtain oil and gas leases for the company, according to a complaint filed in Doddridge Circuit Court.
The plaintiffs claim he was to be compensated with the assignment of "any overriding royalty...of one thirty-second of seven-eights of the gross production proceeds received from the sale of oil and gas, produced from" the leases he acquired, according to the suit.
Antero has drilled wells on the leases and lands that Edward Mullooly, who died and willed his shares to his family, the plaintiffs, but has not paid the plaintiffs their royalties.
The plaintiffs are seeking compensatory damages. They are represented by Edmund Wagoner and Chirah B. Desai of Wagoner & Desai.
