KINGWOOD — Waterfront Group WV is suing Allegheny Wood Products for a property issue.
David L. Hough and Cynthia F. Graves were also named as defendants in the suit.
Allegheny granted Hough and Graves a right of first refusal for 2.98 acres of land in Preston County on Oct. 5, 2004, and on March 3, 2020, Allegheny conveyed over 1,000 acres situated in Preston County to the plaintiff and developed portions of the property for residential use and began to sell the lots, according to a complaint filed in Preston Circuit Court.
A portion of one of the lots was subject to the right of first refusal and after the sale, Hough and Graves demanded to be sold a portion of the lot, despite being aware of the purchase before the sale was consummated, according to the suit.
Waterfront claims the defendants knowingly, intentionally and maliciously failed to release the right of first refusal and/or knowingly, intentionally and maliciously failed to assert their rights until after Waterfront purchased the property from Allegheny, with the intention to cause financial harm
Waterfront is seeking compensatory and punitive damages. It is represented by Michael C. Cardi of Bowles Rice in Morgantown.
The case is assigned to Circuit Judge Stephen Shaffer.
