WHEELING — Grae-Con Construction Inc. filed a lawsuit against Motel Property Development Corporation alleging that it caused harm to Grae-Con's reputation when it blamed the company for damage.

Layafas Architects, Ralph J. Kramer III, Greg Gantzer Inc. and H..E. Neumann Company were also named as defendants in the suit.

Grae-Con claims Motel and Kayafas entered into a contract in 2010 for the design of the Aquatic Center in 2010 and Kayafas and Kramer prepared the construction drawings, according to a complaint filed in Ohio Circuit Court.

Grae-Con was contracted to construct the Aquatic Center in 2011 and subcontracted with Greg Gantzer Inc. as the mechanical subcontractor and throughout the construction, Kayafas reviewed and approved all of the shot drawings and Kramer reviewed and approved the mechanical, electrical and plumbing work.

In 2017, Kayafas emailed Grae-Con regarding spray foam insulation not being applied at the ends of the roof deck and Dave Barbarossa emailed Kayafas about Core-Fill 500, spray-in foam insulation, to stop airflow movement and Grae-Con also remediated a mold issue, according to the suit.

Grae-Con claims Robert Hitchman and Robert Gribben blamed Grae-Con for the moisture issues, despite an expert report opining the issues were construction deficiencies. They claim the defendants breached their warranties and caused their reputation to suffer.

Grae-Con is seeking compensatory damages. It is represented by Teresa J. Dunmire and Matthew D. Elshiaty of Kay Casto & Chaney; and Julian E. Neiser of Spilman Thomas & Battle.
