CHARLESTON — A former employee is suing Kemba Charleston Federal Credit Union alleging that it failed to accommodate her disability.
Lula M. Dustin was employed by the defendant for approximately 18 years and was diagnosed with a medical condition and has been treated for approximately four years for that medical condition, according to a complaint filed in Kanawha Circuit Court.
Dustin claims on Oct. 1, 2020, she had an appointment with her medical provider and received a medical excuse for work and then at her second doctor's appointment that day, she also received a medical excuse and then informed the defendant she would need a temporary leave of absence, according to the suit.
Dustin claims she provided the defendant with short-term disability paperwork. The defendant then denied her request for a reasonable accommodation and terminated her employment.
Dustin is seeking compensatory damages with pre- and post-judgment interest. She is represented by Karen. Miller, Joseph Amos Jr. and Shannon Rogers of Millers & Amos.
The case is assigned to Circuit Judge Tera Salango.
