CHARLESTON — A homeowners association is suing Jonathan and Blessing LLC alleging they are violating homeowners association rules.
Quail Hollow Homeowners Association filed the lawsuit against Jonathan and Blessing and Jonathan Eya and Blessing Eya, who are owners of two single-family homes in the Quail Hollow Subdivision and have owned the homes since 2004 and 2016, according to a complaint filed in Kanawha Circuit Court.
Quail Hollow claims the properties are subject to a restrictive covenant that requires them to be used for residential purposes only, however, the defendants are operating a business from the homes and have refused to cease and desist using the property for business purposes.
Online records show Jonathan and Blessing LLC is an assisted living facility.
"Plaintiff is entitled to enforce the restrictive covenants of Quail Hollow Subdivision and the previous Final Order of this Court in order to prevent the breach of the covenants and injuries being suffered by Plaintiff and all of Plaintiff's members," the complaint states.
Quail Hollow is seeking compensatory damages. It is being represented by Mark Kelley and John Brewster of Ray Winton & Kelley in Charleston.
The case is assigned to Circuit Judge Maryclaire Akers.
