WILLIAMSON — A Kermit man is suing Chojnacki Construction for failing to properly secure construction equipment on a flatbed truck.

Troy Williams was occupying a vehicle that was being operated in a safe, proper and cautious manner on July 15, 2019, when an excavator bucket fell off of a flatbed trailer owned by the defendant and operated by its employee, according to a complaint filed in Mingo Circuit Court.

Williams claims the excavator bucket collided with the vehicle he was in, causing the vehicle to wreck and Williams sustained severe and permanent injuries.

The defendant had a duty to exercise due care when operating its vehicles and securing its equipment and failed to do so, according to the suit.

Williams claims the defendant's reckless and careless driving and failure to properly train its employees, as well as failure to properly secure the bucket and transport equipment in a safe manner caused his injuries.

Williams is seeking compensatory damages. He is represented by Joshua S. Ferrell and Nathan D. Brown of Ferrell & Brown in Williamson.

The case is assigned to Circuit Judge Miki Thompson.
