DOH sues Columbia Gas for deteriorating roads

WINFIELD — The West Virginia Department of Transportation - Division of Highways is suing Columbia Gas alleging that they failed and refused to fix the roads they caused to deteriorate after driving oversized vehicles on them in the process of building a natural gas pipeline.

TransCanada Energy, Henkels & McCoy and 10 unknown and unnamed subcontractors were also named as defendants in the suit.

The DOH entered into a contract with the defendants in January 2017 wherein the defendants had requested permission to operate some overweight and oversized vehicles on Putnam County roads while installing a natural gas pipeline, according to a complaint filed in Putnam Circuit Court.

The DOH claims it was anticipated that traversing the roads would cause some unusual and substantial damage and the defendants agreed that fix the roads after the pipeline project was completed, however, the defendants have refused to fix the roads.

The DOH is seeking compensatory damages. It is represented by Stacy A. Jacques of the DOH's Legal Division in Charleston.
