CHARLESTON — A man is suing Rippetoe Properties Inc. for injuries sustained when he fell on a driveway.

James Rippetoe III, WV Property Solutions and NAJ LLC were also named as defendants in the suit.

James Sotak was utilizing a shared driveway area for ingress and egress in South Charleston when he tripped and fell on the uneven, broken or otherwise negligently maintained driveway, according to a complaint filed in Kanawha Circuit Court.

Sotak claims he suffered serious injuries, including a left nonarticular distal tibia fracture and a comminuted nonarticular fibular fracture.

The plaintiff claims the defendants had a duty to maintain the driveway and failed to do so. He claims they failed to provide sufficient lighting or fix the dangers and/or defects on the driveway.

The defendants' actions were negligent, willful, wanton and reckless, according to the suit.

Sotak is seeking compensatory and punitive damages. He is represented by S. Brooks West II and David A. Dobson of West Law Firm in Charleston.

The case is assigned to Circuit Judge Tera Salango.
