Man sues River City Ford for fraudulent inducement into high-cost, high-interest loan

CHARLESTON — A Charleston man is suing River City Ford and Santander Consumer USA Inc. alleging that he was induced into a high-cost, high-interest purchase and financing of a 2018 Ford Mustang.

Gary Kazee was solicited by River City Ford to purchase a vehicle in its Lavalette car lot on Jan. 6, 2020, according to a complaint filed in Kanawha Circuit Court.

Kazee claims he expressed concern about his credit profile and that he could only pay $500 per month. The defendants told him that the 2018 Ford Mustang he was interested in would be closer to $800 per month, but that if he paid the monthly payment for six months, he could refinance the loan for $500 per month.

However, Kazee quickly realized it could not make the monthly payments and he contacted the West Virginia Attorney General's Office to complain about being induced into the loan and was advised he was covered by a consent judgment entered into regarding Santander, according to the suit.

Kazee claims despite this, the defendants repossed the vehicle. 

Kazee is seeking compensatory damages. He is represented by Bren J. Pomponio and Daniel F. Hdges of Mountain State Justice in Charleston.

The case is assigned to Circuit Judge Tera Salango.
