Woman says she was injured at Planet Fitness due to slippery pull-up bar

CHARLESTON — A Kanawha County woman is suing Planet Fitness after she claims she was injured while she was exercising.

Courtney Mathes was at Planet Fitness on April 9, 2019, and was exercising in the gym when she went to use the pull-up bar and was injured when she fell, according to a complaint filed in Kanawha Circuit Court.

Mathes worked out at the gym nearly every day and on that day, she stepped up on a box to grab ahold of the bar and found that the pull-up bar had been sprayed with some type of liquid. Because she could not properly grab onto the bar, she slipped and fell to the ground and was injured.

The plaintiff claims she was then informed she needed to wear gloves or use chalk when using the pull-up bar but had never been told this before, nor was either of those items provided by the staff. She claims she continues to suffer pain in her arm from her fall and her elbow still makes a popping sound that cannot be fixed with medical treatment.

Mathes is seeking compensatory damages with pre- and post-judgment interest. She is represented by Joseph Spano Jr. and Faun Cushman of Pritt & Spano in Charleston.

The case is assigned to Circuit Judge Jennifer Bailey.
