WILLIAMSON — Foster Foundation is suing Consol of Kentucky alleging the defendant has failed to reimburse the foundation for taxes paid pursuant to a lease.
Foster Foundation entered into a lease with Fremont Coal Company on June 1, 1992, and Fremont later merged with Consol of Kentucky, according to a complaint filed in Mingo Circuit Court.
Foster claims Consol has failed and refused to reimburse Foster for all taxes paid by Foster as required under the lease and has not given any notice of termination of the lease to Foster.
On Oct. 15, Consol was provided with a notice of the requirement to reimburse for the taxes and has not made any effort to contact Foster since then and interest is now accruing on the sums owed by Consol to Foster, according to the suit.
Foster claims Consol owes $19,549.79 for the taxes,
Foster is seeking $19,549.79 with interest at the rate provided in the contract. It is being represented by Daniel J. Konrad of Dinsmore & Shohl in Huntington.
The case is assigned to Circuit Judge Miki Thompson.
