Former employee says Panera Bread discriminated against her based on pregnancy complications

BECKLEY — A Raleigh County woman says Flynn Restaurant Group for pregnancy discrimination.

Pan American Group and Pan Pennsylvania, which is doing business as Panera Bread, were also named as defendants in the suit.

Brooklynn Oglesby worked for the defendants as a certified trainer and was seven months pregnant in March 2020 when she began to experience pregnancy complications that culminated in a stillbirth, according to a complaint filed in U.S. District Court for the Southern District of West Virginia

Oglesby claims the pregnancy complications, hospitalization and recovery required her to miss work and she kept the defendants informed of her condition. On March 25, 2020, she was furloughed and directed to file for unemployment benefits, however, the defendants then challenged her unemployment claim and said she and quit and abandoned her job.

Oglesby claims the defendants violated the West Virginia Human Rights Act and the Family and Medical Leave Act. 

Oglesby is seeking compensatory and punitive damages. She is represented by Richard W. Walters and Carl W. Shaffer of Shaffer & Shaffer.
