Woman sues Dollar General for injuries

PINEVILLE — An Oceana woman is suing Dollar General after she was injured while in one of its stores in 2019.

Sherry West was at Dollar General on May 2, 2019, which was an extremely windy day, when a sales rack known as a rotator was on the sidewalk out of the store and the rotator fell onto West's car, according to a complaint filed in Wyoming Circuit Court.

West claims she and an employee of Dollar General attempted to remove the rotator from her car and in the process of doing so, she was suffered serious and permanent injuries to her right shoulder.

The plaintiff sustained a SLAP tear and partial bicep tear to her right shoulder, which required surgery, according to the suit.

West claims the rotator should have been secured so that it would not have fallen on her car. She claims the defendant was negligent in failing to secure the rotator.

West is seeking compensatory and punitive damages. She is represented Kirk Lightner of New Taylor & Associates in Beckley.
