Man sues METS Properties for hazardous catwalk, tunnel

MOUNDSVILLE — A man is suing METS Properties alleging that a catwalk and tunnel are hazardous.

Kenny Hope owns property on Jefferson Avenue in Moundsville and METS owns property on Morton Avenue, according to a complaint filed in Marshall Circuit Court.

Hope claims METS erected a tunnel and catwalk that interfere with his use and enjoyment of his property. He claims the tunnel and catwalk are a fire hazard and a public nuisance.

"Mr. Hope brings this action to enjoin and restrain METS Properties from continuing to possess the catwalk and force METS Properties to take remedial action related to the hazardous fire conditions posed by the tunnel," the complaint states.

Hope claims he wants the catwalk and tunnel removed and the hazardous conditions posed by them to be fixed.

Hope is seeking a judgment in his favor and to grant a permanent injunction enjoining the defendants to seal the tunnel and remove the catwalk. He is representing himself.
