Couple says Mercedes-Benz was defective

CHARLESTON — A Kanawha County couple is suing Mercedes-Benz USA alleging that a vehicle they leased was defective.

Timothy Skeldon and Magali Skeldon leased a 2020 MB LT Truck on Aug. 17, 2020, but they soon discovered and experienced repeated nonconformities that impaired their use of the vehicle, according to a complaint filed in Kanawha Circuit Court.

The Skeldons returned the vehicle to the dealership several times, but the defendants failed to repair the vehicle to bring it into conformity with its warranties. They claim they also notified the manufacturer of the defective conditions of the vehicle.

The defendant also failed and refused to provide a comparable replacement vehicle or to reimburse the plaintiffs, according to the suit.

The Skeldons are seeking revocation of the vehicle, as well as compensatory and punitive damages. They are represented by Charles M. Love IV of the Love Law Firm in Charleston.

The case is assigned to Circuit Judge Tera Salango.
