CHARLESTON — A couple is suing Waste Management of West Virginia Inc. alleging that a driver drove a Waste Management vehicle into a gatepost and damaged their property.
Waste Management went to the home of Roger Lipscomb and Connie Lipscomb on Jan. 14, to empty a Waste Management Dumpster on their property and, when leaving, impacted the gatepost on their property and left green paint behind on the gate post, according to a complaint filed in Kanawha Circuit Court.
The Lipscombs claim the driver did not contact law enforcement or the plaintiffs before leaving the scene of the incident.
When Roger Lipscomb discovered the damage, he contacted Waste Management and spoke to an employee who indicated she'd have someone come from the office to inspect the damage and an employee came and indicated there was no question that a Waste Management truck had caused the damage, according to the suit.
The Lipscombs claim despite that, they spent several days dealing with Waste Management before the company agreed to pay damages, however, they only agreed to pay $3,000 toward the $4,116 estimate for the repairs.
The plaintiffs allege they had to pay the rest out of pocket because Waste Management refused to pay in full for the damages they caused.
The Lipscombs are seeking compensatory damages. They are represented by Michael M. Cary of Cary Law Office in Charleston.
The case is assigned to Circuit Judge Tera Salango.
