Couple sues Speedway for injuries

CHARLESTON — A Logan County couple is suing Speedway for injuries sustained on its premises.

Margaret Caldwell and Roger Caldwell filed a lawsuit against Speedway in Kanawha Circuit Court after Margaret Cadwell was injured on Feb. 25, 2020, according to a complaint filed in Kanawha Circuit Court.

Margaret Caldwell was in Speedway in Logan County and when she opened the door, it closed quickly, catching her left wrist and hand in the door and causing her injuries.

The defendant had previously been made aware of the issue on the premises and they had a duty to property fix, repair, maintain and warn of the dangerous condition and failed to do so, according to the suit.

The Caldwells claim the defendant was negligent and careless and breached its duty by allowing Margaret Caldwell to sustain serious injuries.

The Caldwells are seeking compensatory damages. They are represented by Gregory B. Chiartas of Freeman & Chiartas.

The case is assigned to Circuit Judge Tera Salango.
