Woman sues Marshalls for injuries from substance in floor

CHARLESTON — A woman is suing Marshalls of MA Inc. alleging that she was injured while in the defendant's store.

Christina Marcus was inside Marshalls in South Charleston on Aug. 2, 2020, when she slipped on a substance in the floor, according to a complaint filed in Kanawha Circuit Court.

Marcus claims the slippery substance also contained broken glass, which caused her injuries. She claims the defendant knew or should have known about the hazardous condition due to the broken glass having created a sound that would have alerted a reasonable and prudent person of the hazard.

The defendant had a duty to maintain its premises and failed to do so, according to the suit. Marcus claims the defendant breached its duty and was negligent, which caused or contributed to her injuries, including lower back pain.

Marcus is seeking compensatory damages with pre- and post-judgment interest. She is represented by Scott H. Kaminski of Ray Winton & Kelly in Charleston.

The case is assigned to Circuit Judge Carrie Webster.
