Couple sues multiple defendants for toxin exposure

CHARLESTON — A man and his wife filed a lawsuit against State Electric Supply Company claiming that he was exposed to toxic substances while employed by Union Carbide.

State Electric Supply Company, Oliver Fuels & Oils, Appalachian Timber Services, Acme Wood Preserving, Radiator Specialty Compay, Kano Laboratories, CRC Industries, Safety-Kleen Systems, Ashland LLC, Exxon Mobile, Lyondell Chemical, United States Steel Corporation, ViacomCBS Inc., General Electric Company, CoGo Group, Monsanto Company, Solutia Inc., Pharmacia, Pfizer, Bayer Cropscience and Kirby Corporation were all named as defendants in the suit.

Jay Templeton and Dawn Templeton claim Jay Templeton was exposed to toxic and carcinogenic agents, including polychlorinated biphenyls (PCBs) through his employer, Union Carbide, where he worked for more than 43 years in various job classifications, according to a complaint filed in Kanawha Circuit Court.

Jay Templeton was exposed to various carcinogenic products as a result of the defendant's actions and/or inactions and he developed non-Hodkin's lymphoma due to the exposure, according to the suit.

The Templetons are seeking compensatory and punitive damages. They are represented by R. Dean Hartley, E. William Harvit, David B. Lunsford and Sean X. Xing of Hartley Law Group in Wheeling.

The case is assigned to Circuit Judge Tera Salango.
