Woman sues Dynamic Structures for husband's death

MOUNDSVILLE — A woman is suing Dynamic Structures Inc. for her husband's death after a workplace accident.

Dynamic Structures is doing business as Clearcreek Oilfield Solutions.

Haley L. Rothenbuhler, as personal representative of the estate of Robert Rothenbuhler, alleged that on Jan. 22, 2020, Robert Rothenbuhler was supervising a drill hole dewatering project to evacuate water from a hole by utilizing a "pigging" operation of pushing a "pig" through a water line by use of compressed air generated by a compressor, according to a complaint filed in Marshall Circuit Court.

Haley Rothenbuhler claims the employees performing the service knew or should have known that the bottle container could only safely hold 15 psi of water/air, but they failed to open the top hatch or any other pressure release valves, which caused the bottle truck to over pressurize, blow its back hatch out and hit Robert Rothenbuhler, throwing him a distance away and causing injuries to his head and body, which eventually lead to his death.

The risk of harm was foreseeable and the defendant was negligent, according to the suit.

Haley Rothenbuhler is seeking compensatory damages. She is represented by Donald J. Tennant Jr. of Tennant Law Offices in Wheeling and Daniel L. McCune of Rokisky McCune Wilharm & Blair in Weirton.
