Woman blames O'Reilly's for accident with company van

CHARLESTON — A woman is suing O'Reilly Auto Stores claiming she was injured in a car accident caused by one of its employees.

Christina Lynn Rife, an employee of O'Reilly, was also named as a defendant in the suit.

Rebecca L. Smith was stopped in her vehicle on May 2, 2019, on MacCorkle Ave. in St. Albans when Rife, who was operating an O'Reilly van, collided with her vehicle, according to a complaint filed in Kanawha Circuit Court.

Smith claims the investigating officer noted in the accident report that Rife was following too closely to Smith's vehicle.

Smith claims she suffered injuries and damages as a result of the car accident that was Rife's and O'Reilly's fault.

"As a direct and proximate result of the negligence, carelessness and recklessness of the Defendants...Smith sustained injuries, has incurred medical expenses and other economic and noneconomic damages and will incur additional medical expenses and other economic and noneconomic damages in the future..." the complaint states.

Smith is seeking compensatory damages. She is represented by Truman C. Griffith of Warner Law Offices in Charleston.

The case is assigned to Circuit Judge Joanna Tabit.
