Man sues CSX for property damage, injuries

CHARLESTON — A man is suing CSX Transportation alleging he was injured when he struck a pile of gravel that was not supposed to be near a set of railroad tracks in St. Albans.

Robert Jewett was operating a 2006 Chevy Trailblazer on May 15, 2020, near a railroad crossing on Vista Drive in St. Albans when he struck a pile of gravel that was negligently and carelessly placed, according to a complaint filed in Kanawha Circuit Court.

Jewett claims the defendant's negligent and careless conduct caused him to sustain serious injuries, damages, physical injury, medical expenses, mental anguish, pain and suffering, annoyance and inconvenience, loss of enjoyment of life and property damage.

The complaint says Jewett's Trailblazer also was damaged.

"That as a proximate result of the Defendant's negligent and careless conduct and actions, the Plaintiff sustained property damage to his vehicle," according to the suit.

Jewett is seeking compensatory damages with pre- and post-judgment interest. He is represented by G. Patrick Jacobs of the Law Office of G. Patrick Jacobs in Charleston.

The case is assigned to Circuit Judge Louis Bloom.
