HUNTINGTON — An Ohio man is suing Special Metals for wrongfully terminating his employment.
Huntington Alloys Corporation is doing business as Special Metals.
Jack Miller was employed by Special Metals from 1992 until Dec. 15, 2020, according to a complaint filed in U.S. District Court for the Southern District of West Virginia.
Miller claims Special Metals has an "Ethics Point" hotline for employees to report discrimination and other improper work practices and in 2014, an investigation arose after someone accused Miller of using a racial epithet in a conversation with another employee. Miller denied having made the remark, but Special Metals determined he did, but that it did not warrant his termination.
On Nov. 11, 2020, Miller received a call that he had an "Ethics Point" case against him, but the specifics of the case were not shared with him, however, later he discovered it was the 2014 investigation against him and the defendant claimed they had no previous investigation records, according to the suit.
Miller claims he was terminated for the incident and then replaced by a substantially younger employee.
Miller is seeking compensatory and punitive damages. He is represented by Hoyt Glazer, Abraham Saad and Eric Anderson of Glazer Saad Anderson in Huntington.
