Coal miner, wife sue companies for faulty respirators

State Court
Coal 1200x675

PINEVILLE — A Wyoming County couple is suing 3M Company alleging faulty respirators caused him to develop a lung disease.

Mine Safety Appliances Company, American Optical Corporation, Aearo Technologies, Raleigh Mine and Industrial Supply and Eastern States Mine Supply were also named as defendants in the suit.

Garrett D. Lambert and Amanda Sue Lambert claim respirators used by Garrett Lambert during his employment as a coal miner failed to protect him and caused him to develop pneumoconiosis, also known as CWP, according to a complaint filed in Wyoming Circuit Court.

The Lamberts claim the defendants manufactured the respirators that Garrett Lambert wore during his career as a coal miner between 1998 and 2020.

The defendants' respirators leaked substantial amounts of harmful dust into his breathing zone and caused his injuries, according to the suit.

The Lamberts are seeking compensatory and punitive damages. They are represented by Ashley N. Lynch and Guy R. Bucci of Hendrickson & Long in Charleston.

Wyoming Circuit Court case number: 21-C-48
