FAYETTEVILLE — A man is suing Montgomery General Elderly Care Center for injuries during his stay at the facility.
Montgomery General Elderly Care Center is doing business as Montgomery Rehab and Nursing.
Dale Arthur Penn presented to the emergency room at Charleston Area Medical Center on May 4, 2020, with complaints of a broken ankle and underwent surgery to repair his ankle, after which he went to Montgomery Rehab until June 16, 2020, according to a complaint filed in Fayette Circuit Court.
Penn claims he developed multiple severe pressure sores at Montgomery and had to be taken to Charleston Area Medical Center for hospitalization, surgery and extended skilled nursing care. He claims the defendants were negligent in his care.
Penn is seeking compensatory and punitive damages. He is represented by L. Dante DiTrapano, David H. Carriger and Bradley D. Dunkle of Calwell Luce DiTrapano in Charleston; and Richard D. Lindsay II and Dr. Richard D. Lindsay of Tabor Lindsay & Associates.
The case is assigned to Circuit Judge Thomas Ewing.
