FAYETTEVILLE — The Fayette County Commission is suing the Continental Insurance Company for documents regarding a policy for property damage that it is liable for coverage.
In a case involving groundwater and surface water contamination within the Johnson Fork-Loop Creel watershed, the insurance company issued an umbrella excess third party liability insurance policy to Eastern Gas & Fuel Associates and its subsidiaries, according to a complaint filed in Fayette Circuit Court.
The commission claims it gave the insurance company more than four months to respond to the civil information demand regarding its policies, but, to date, it has not produced any of the documents or information regarding policy applications, underwriting information or claims made against the policies.
The commission is seeking for the insurance company to release the requested records within 14 days and fees and expenses associated with the case. It is represented by Michael Callaghan.
