Father sues school board for son's attack by bully

WILLIAMSON — A father is suing the Mingo County Board of Education claiming it is responsible for injuries his son suffered when he was attacked by another student.

John Ball and his minor son, D.B., filed the lawsuit after an incident that occurred during D.B.'s freshman here in 2019 at Mingo Central High School, according to a complaint filed in Mingo Circuit Court.

Ball claims D.B. was in gym class when he was attacked by another student, Z.B., when he was not provoked.

D.B. covered his head to attempt to stop the assault but he was unsuccessful and no one did anything to stop the attack, according to the suit.

Ball claims neither the teacher nor other adult came to his rescue and it wasn't until the attack was over when the gym teacher spoke him about the fight, but did not report the attack to D.B.'s family.

Ball claims later an officer with the Mingo County Sheriff's Department investigated and criminal charges were filed against Z.B.

Ball is seeking compensatory damages for his son's injuries and embarrassment and humiliation. He is being represented by Kirk D. Lightner of New Taylor & Associates.
