Man sues Bluefield State College alleging failure to pay disability benefits

PRINCETON — A Bluefield man is suing Bluefield State College alleging it failed to provide him with disability benefits.

The Bluefield State College Board of Governors and Standard Insurance Company were also named as defendants in the suit.

Daniel L. Frost was employed by the defendants for several years and participated in the defendants' long-term disability insurance coverage, according to a complaint filed in Mercer Circuit Court.

Frost claims he had surgery on Feb. 28, 2018, involving his cervical spine and for treatment of cervical spondylolysis and myelopathy, however, after the surgery, he was unable to return to work and filed for long-term disability. His employment was then terminated.

The plaintiff alleges that after his employment was terminated, he was granted disability benefits on March 17, 2020, under the Social Security Act, despite the defendant denying his long-term disability claim in 2018.

Frost claims the defendants breached their contract and he is owed disability payments under his policy.

Frost is seeking compensatory damages. He is represented by Derrick W. Lefler.

The case is assigned to Circuit Judge Derek Swope.
