Man sues McDonald's for injuries after falling on black ice in parking lot

WHEELING — A man is suing McDonald's after he was injured in a parking lot due to black ice.

David Waddell went to McDonald's on Feb. 8, 2020, purchased a cup of coffee and exited the restaurant when he slipped on black ice and injured his left shoulder, according to a complaint filed in Ohio Circuit Court.

Waddell claims he informed the restaurant's manager and was informed there was a leak from the roof onto the sidewalk and that water had frozen due to the temperature. He was informed the restaurant had run out of salt so they could not salt the sidewalk.

The plaintiff suffered injury and harm as a result of the defendant's negligence, according to the suit.

Waddell is seeking compensatory damages with pre- and post-judgment interest. He is represented by Craig L. Fishman of Shenderovich, Shenderovich and Fishman.
